Terms of Service

Last updated: [Effective date]

Please read these terms before you use HiVouch. They explain what you can expect from us and what we expect from you.

1. Who we are and what these terms cover

HiVouch is a product of DevLab Technologies ("HiVouch", "we", "us"), based in Cairo, Egypt. Our registered address is [Registered address] and our commercial registration number is [Commercial registration number].

These terms are the agreement between us and the business or person that opens a HiVouch account ("you", the "customer" or "tenant"). They apply to the HiVouch API, the hosted verify page, the embeddable widget, the "Sign in with HiVouch" OpenID Connect service, the dashboard and any related documentation (together, the "Service"). By creating an account or using the Service you agree to these terms, the Privacy Policy, the Acceptable Use Policy and the Refund Policy.

If you accept these terms for a company, you confirm that you have authority to bind it.

2. The Service

HiVouch is a reverse WhatsApp OTP verification service. Instead of receiving a code, the end user sends a WhatsApp message to a HiVouch number, or to your custom number, to prove they own a phone number. You integrate the Service through our API, the hosted verify page, the embeddable widget or OpenID Connect.

The Service depends on the WhatsApp Business Platform operated by Meta Platforms. We do not control it, and a verification can fail or be delayed because of it. We may change, add or remove features, and we will give reasonable notice of changes that materially reduce what you rely on.

3. Your account

  • You must give accurate information, including for any identity documents (KYC) we ask for before enabling a custom number or live mode.
  • You are responsible for your team members, your API keys and everything done with them. Keep keys secret and tell us at once at [email protected] if one is exposed.
  • You may invite team members. You are responsible for their compliance with these terms.
  • You must be able to enter a binding contract under the laws that apply to you.

4. Fees and payment

  • HiVouch is prepaid. You buy packages of verifications. All prices are in US dollars (USD) and are set in our price list, which you can see on the pricing page.
  • You get 100 free verifications every day. A verification is charged only when it succeeds.
  • A package expires 12 months after purchase. When you hold more than one package we use the oldest first. Unused verifications in an expired package are lost.
  • A custom number carries a yearly fee shown in the price list.
  • Payments are processed by ezPayments. We do not store your card details.
  • We do not charge VAT to customers in Egypt.
  • Prices can change. We tell you about a price change by email and by webhook before it applies to you. A package you have already paid for keeps the verifications you bought.
  • If Meta starts charging for service messages in a country, we may add a per-country surcharge for that country after giving you 30 days' notice.
  • Refunds are governed by the Refund Policy.

5. Your responsibilities

You are responsible for how you use the Service and for the people whose phone numbers you verify. In particular you must:

  • follow the Acceptable Use Policy and the WhatsApp Business and Meta policies that apply to the Service;
  • have a lawful basis, and give any notices required by law, before you ask an end user to verify through HiVouch;
  • keep your integration secure and verify webhook signatures and tokens as described in our documentation;
  • not rely on a verification as the only evidence of identity where the law or the risk requires more.

6. Data and privacy

For data about your account, HiVouch is the controller. For data about your end users, HiVouch is a processor acting on your instructions and you are the controller. Our Privacy Policy and Data Processing Addendum explain this and form part of these terms.

7. Intellectual property

We own the Service, its software, documentation and brand. We give you a limited, non-exclusive, non-transferable right to use the Service during your account's life, in line with these terms. You keep all rights in your own data, your brand and the content you configure, and you give us the right to use them only to run the Service for you.

Do not copy, resell, reverse engineer or build a competing service from the Service, except where the law allows it despite this term.

8. Availability and support

We work to keep the Service available but we do not promise it will be uninterrupted or error free. Planned maintenance, problems at Meta or at our other providers, and events outside our control can interrupt it. Contact [email protected] for help.

9. Suspension and termination

  • You can close your account at any time from the dashboard or by emailing [email protected]. Closing it does not by itself entitle you to a refund; see the Refund Policy.
  • We may suspend or end your access at once, with notice where we can, if you breach these terms or the Acceptable Use Policy, if we are required to by law or by Meta, if your use threatens the Service or other customers, or if a payment is reversed or disputed.
  • We may end your account for any other reason with 30 days' notice.
  • When your account ends we delete or return your data as set out in the Privacy Policy and the DPA. Sections that by their nature should survive, such as liability, governing law and unpaid fees, do.

10. Disclaimers

The Service is provided "as is" and "as available". To the extent the law allows, we give no warranty that it will be fit for a particular purpose, that every verification will succeed or be delivered in a certain time, or that it will be free of errors. A verification shows that a person controlling a WhatsApp account sent a message from a phone number. It is not proof of identity.

11. Limitation of liability

To the extent the law allows:

  • we are not liable for indirect or consequential loss, loss of profit, revenue, data or goodwill; and
  • our total liability for all claims relating to the Service in any 12 months is limited to the amount you paid us in the 12 months before the event that gave rise to the claim.

Nothing in these terms limits liability that cannot be limited under the law, including for fraud or intentional wrongdoing.

12. Indemnity

You will defend and compensate us against claims, fines and costs brought by a third party, including a regulator or Meta, that arise from your breach of these terms or the Acceptable Use Policy, or from your end users' data being collected or used without a lawful basis.

13. Changes to these terms

We may update these terms. We will tell you by email or in the dashboard at least 30 days before a material change takes effect. If you keep using the Service after that date you accept the new terms. If you do not accept them, you can close your account before then. The date at the top of this page shows the latest version.

14. Governing law and disputes

These terms are governed by the laws of the Arab Republic of Egypt. The competent courts of Cairo have exclusive jurisdiction over any dispute, unless the law gives you the right to bring a claim elsewhere. Before starting a claim, please write to [email protected] so we can try to settle it.

15. General and contact

  • These terms, with the documents they refer to, are the whole agreement between us about the Service.
  • If a part of these terms is found unenforceable, the rest stays in force.
  • If we do not enforce a right, that is not a waiver of it.
  • You may not transfer your rights under these terms without our written consent. We may transfer ours as part of a merger or sale of the business.
